New Illinois Law Expands Sealing Eligibility

A new state law that goes into effect this month has expanded the eligibility for sealing criminal records. Under the new legislation, ex-offenders can now petition the Prisoner Review Board for eligibility to seal a Class 3 and 4 felony conviction from their criminal records, so long as the charge was not for violence, sex, or DUI. Previously, the only convictions that were eligible to be sealed were Class 4 drug crimes and prostitution. The change in the law means the potential for many new individuals to have their records sealed from the public, allowing them expanded opportunities to fully integrate back into society.

Bipartisan bills were introduced in the Illinois House and Senate in February of last year. A final bill passed both houses in May, and was signed into law by Governor Quinn in August. Getting such legislation enacted is no easy task. According the Illinois Press Association, similar bills have been proposed in the last five years, but have failed to make it out of committee.

Hello,

I am a resident of TN, and have 4 convictions on my record. 3 are in TN, which include possession of Marj - misd, resisting arrest - misd ( non violent), and public intoxication - misd. These charges are more than ten years old. In addition, I have a class 4 felony in IL - pos of burg tools. I'm wondering if you can tell me if I would fall under the new law to have my record expunged or sealed, and how much this process would cost if my case is applicable.

I was wondering if you could confirm what Michael is saying below. Could you go befroe the judge or would you have to go before the board of P&P.

The new law gives the Prisoner Review Board the power to grant special authorization to have a case sealed when they would otherwise not be eligible. If that authorization is granted, then you must petition the court to actually order the case sealed.

It's a two step process. First before the PRB, then before the court.

Michael G., though the rules are not formalized yet on JCAR, the PRB is accepting petitions now.

When will it be possible to do this. The law is still being written in JCAR. Any word when it will be done so people can achieve the sealing? Does one have to go in front of the Prisoner Review Board or can one go in front of the Chief Judge of the county in which they were convicted?

If the perimeters of the Sealing Bill were expanded, I do not believe that you would have to go before the PRB. You should now be able to follow the procedures with either help from an attorney with the necessary paperwork, or just file it yourself.

I have a class 3 forgery felony conviction & I was informed that it may be able to be sealed as of 1/2013 because of a new law passed in Illinois. I wanted to know is that true and if so what are the steps I need to take to do so.

hello I pled guilty to obstructing justice back in 2008 and got 3 years of reporting probation. I did that probation with out standing service. and no more trouble with the law. can I now get this expunged or sealed? also had a disorderly conduct charge did 10 days in the local jail can that be expunged as well

I know someone with a class 1 felony charge non violent drug related that happened in 1992 when they were 17 yrs old in illinois. Is there any way they could seal or clear their record? They have never been in trouble since. Could they be granted a pardon?

I have a friend that was convicted of a felony for illegal use of flashing/rotating lights when he was 18 just months before the charge became a misdemeanor offence. Would he have a chance of getting that felony expunged or sealed?

I have a friend, Hispanic male in his 40s, who did some stupid crap over 20 years ago in a county west of Chicago. Three felony convictions for firearms.

Is it possible to remove these records so that he can vote and own firearms? Or run for public office?
