Now that another avenue has opened for those sentenced to misdemeanor level violent offenses, it will help many to pass the background checks that had been standing in the way of them moving on with their lives.
As we pointed out in June, the Illinois legislature passed a bill that changed the Criminal Identification Act to make most misdemeanor violent crimes eligible for sealing. Last week, Governor Quinn signed the bill, as was expected, officially making it law. The new law will take effect on January 1, 2015.

What types of violent crimes can be sealed? I was convicted of a misdemeanor crime at age 17 and charged as an adult. Although I plead guilty, even though I feel I was being wrongfully charged, the only option I have had was to seek executive clemency (pardon). I have asked if a judge would re-review the case but the statue of limitations was in effect being that I was charged and convicted over 12 years ago. I had no idea the repercussions from my conviction would prevent me from entering the military and have since mournfully regretted my decision.

Would I be eligible for an expunged record with this new law? Is unlawful restraint considered domestic violence? I have an unlawful restraint class 4 felony. It has been almost 19 years and no arrested or trouble since the incident with my ex. I'm just tired of being held back by a mistake that happened long ago. Any help would be greatly appreciated.
